We ask that you read this privacy notice carefully as it contains important information on who we are, how and why we collect, store, use and share personal information, your rights in relation to your personal information, and on how to contact us and supervisory authorities in the event you have a complaint.

 

Who we are

Stephen Charles Landscapes Design Limited collects, uses and is responsible for certain personal information about you. When we do so, we are regulated under the General Data Protection Regulation which applies across the European Union (including the United Kingdom) and we are responsible as ‘Controller’ of that personal information for the purposes of those laws.

 

The personal information we collect and use

We may collect personal identification information from you in a variety of ways, including but not limited to when you visit our website, register on the site, request a quote or place an order for our services, fill out a form, respond to a survey, subscribe to the newsletter and in connection with other activities, services, features or resources we make available. 

You may be asked for, as appropriate, name, postal address or address the services are to be performed or goods delivered, email address, telephone or mobile number, bank account or debit or credit card information to process payments.

We collect and use personal information for the following purposes:

Your information helps us to more effectively respond to your customer service requests and support needs.

Who we share your personal information with

We will only share your personal information with sub-contractors to fulfil contractual obligations entered into with you for the supply of goods and/or services.

 

We may use third party service providers to help us operate our business and our website or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission.

How we protect your information

We have appropriate security measures in place to prevent personal information from being accidentally lost, or used or accessed in an unauthorised way. We limit access to your personal information to those who have a genuine business need to know it. Those processing your information will do so only in an authorised manner.

 

We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

 

Whether information has to be provided by you and if so, why

The provision of personal data (eg name, address, delivery address) is required from you to enable us to fulfil our contractual obligations and provide the services you requested. We will inform you at the point of collecting information from you whether you are required to provide the information to us.

 

Changes to this privacy policy

Stephen Charles Landscapes Design Limited has the discretion to update this privacy policy at any time. When we do, we will revise the updated date at the bottom of this page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

Your rights 

Under the General Data Protection Regulation, you have a number of important rights free of charge. In summary, those include rights to:

 

  • fair processing of information and transparency over how we use your personal information

  • access to your personal information and to certain other supplementary information that this Privacy Notice is already         designed to address

  • require us to correct any mistakes in your information which we hold

  • require the erasure of personal information concerning you in certain situations

  • receive the personal information concerning you which you have provided to us in a structured, commonly used and     machine-readable format and have the right to transmit those data to a third party in certain situations

  • object at any time to processing of personal information concerning you for direct marketing

  • object to decisions being taken by automated means which produce legal effects concerning you or similarly significantly affect you

  • object in certain other situations to our continued processing of your personal information

  • otherwise restrict our processing of your personal information in certain circumstances.

  • let us have enough information to identify you, 

  • let us have proof of your identity and address (a copy of your driving licence or passport and a recent utility or credit card bill), and

  • let us know the information to which your request relates.

 

If you would like to unsubscribe from any email newsletter, you can also click on the ‘unsubscribe’ button at the bottom of the email newsletter. It may take up to 5 days for this to take place. We will also unsubscribe you if our newsletter remains unopened after six months. 

 

How long your personal information will be kept

We will hold personal data for seven years after the performance of a contract in case of any enquiries from HMRC. If we give you any guarantees that are in excess of seven years, then we will keep personal data for the duration of the guarantee. 

 

We will hold personal data in relation to quotations where we were not contracted to supply goods and services for two years unless you request their immediate removal.

 

Where you have opted to participate in a free draw only, personal data will be deleted within 28 days of completion of the draw.

 

Where you have opted to participate in future research, personal information will be stored until the individual unsubscribes, upon which it will be promptly and permanently deleted.

 

Lawful basis for processing

The General Data Protection Regulation requires that the lawful basis and purpose for processing personal data are determined, documented and published in our Privacy Policy before processing begins. There are six lawful bases for processing, four of which are valid for us:

  1. Consent: you have given clear consent for us to process your personal data for a specific purpose.

  2. Contract: the processing is necessary for a contract you have with the us, or because you have asked us to take specific steps before entering into a contract.

  3. Legal obligation: the processing is necessary for us to comply with the law (not including contractual obligations).

  4. Legitimate interests: the processing is necessary for our legitimate interests or the legitimate interests of a third party unless there is a good reason to protect the individual’s personal data which overrides those legitimate interests.

At least one of the above must apply whenever we process personal data.

 

Cookies and similar technologies

A cookie is a small text file which is placed onto your device (eg computer, smartphone or other electronic device) when you use our website. We use cookies on our website. These help us recognise you and your device and store some information about your preferences or past actions.

How to complain

We hope that our Data Protection Officer can resolve any query or concern you raise about our use of your information.

 

The General Data Protection Regulation also gives you right to lodge a complaint with a supervisory authority, in particular in the European Union (or European Economic Area) state where you work, normally live or where any alleged infringement of data protection laws occurred. Changes to this privacy notice

This privacy notice was published on September 2018. We may change this privacy notice from time to time - when we do, we will inform you via email.
